- 1All content present on this website and in the product ACEMF Nxt.. ("PRODUCT") is the exclusive property of Accord Fintech Pvt. Ltd. ("ACCORD"). All title, ownership, copyrights, or other intellectual property rights of the PRODUCT are with ACCORD.
- 2ACCORD grants you, a subscription based, non-exclusive and non-transferrable License to use the PRODUCT. A PRODUCT subscribed by you is for your internal research purpose until the expiry of the subscription to the product.
- 3Use of the PRODUCT is permitted only to you. You shall not allow or permit to use the PRODUCT to any third party or your affiliates. You should appropriate measures to safeguard the PRODUCT from unauthorized access, use or copying.
- 4You agree that without the written consent of ACCORD in advance, you may not broadcast, sell, distribute, reproduce, display, publish, retransmit, disseminate, perform, create new works from, or commercially exploit the content available through the PRODUCT.
- 5You, the user, assume the entire risk with respect to the use, results of such use, in terms of the accuracy, reliability, completeness, comprehensiveness, correctness, functionality, performance, continuity, timeliness of the information, data or any content available on the PRODUCT.
- 6In no event ACCORD or their affiliates will be liable for any expense, loss or damage, including, without limitation, indirect or consequential loss or damage, arising out of or in connection with the use of this PRODUCT. Furthermore, ACCORD shall have no responsibility or liability for delays or failures such as hardware and software failures, malware, virus, DDos attacks or any other circumstances which are beyond their control.
- 7Your subscription will start on the date of PRODUCT installation at your premises. Both the parties’ reserves the right to terminate a subscription prior to completion of the Validity Period at any time, without assigning any reason, provided that at least 30 days’ advance written notice of termination is given to the non-terminating party by the terminating party. However, the subscription fees paid by you is not refundable. In the case ACCORD terminates the Contract at any time , ACCORD will refund you the subscription fee after deducting the statutory charges on pro-rata basis.
- 8In case of expiry or termination of the contract you will cease to use the PRODUCT provided by the ACCORD, You will destroy /delete all ACCORD data from its archives, back-up and any other media and will also certify that it has done so. You can only retain the derivative data of the PRODUCT which is essential as per the compliance.
- 9In the event of any disputes, differences, claims or questions arising between the Parties, the Parties shall first endeavor to settle such differences, disputes; claims etc., in mutual consultation and failing such settlement, such questions shall be referred to arbitration. The arbitration shall be conducted by arbitrator appointed by mutual discussion by both the parties. Such arbitration shall be held in accordance with the Arbitration and Conciliation Act 1996 or any modification thereof for the time being in force. The arbitration proceedings shall be held in Mumbai, India and shall be in English.
- 10This Site may undergo periodic update and revision. ACCORD maintains the right to delete or modify information on this Site without prior notice.
